1. Introduction
These Terms & Conditions (“Agreement”) govern your (“Customer”, “you”, “your”) use of the services provided by Washington Firewood (“Company”, “we”, “us”, “our”). By placing an order, scheduling delivery, or otherwise engaging our services, you agree to be bound by this Agreement. If you do not agree, you may not use our services.
2. Services
2.1 We provide residential and commercial firewood supply and delivery services, including bulk orders and seasonal delivery.
2.2 The specific details of your order, including quantity, delivery, pricing, and timing, will be outlined in your order confirmation, invoice, or quote.
2.3 Any modifications or additional services must be confirmed and may result in additional charges.
3. Customer Responsibilities
3.1 You must provide safe and reasonable access for delivery, including clear driveways and appropriate drop locations.
3.2 You represent that you are authorized to request delivery at the property.
3.3 You are responsible for ensuring the delivery area is suitable and free from hazards.
3.4 You agree to notify us promptly of any issues or concerns with your order.
4. Pricing, Payment & Cancellation
4.1 Pricing is provided at the time of order or quote. Payment terms will be specified, and prepayment may be required.
4.2 Cancellations within 48 hours of scheduled delivery may incur a fee.
4.3 Late payments may incur additional charges.
4.4 We reserve the right to refuse or delay service for non-payment.
5. Delivery & Scheduling
5.1 Delivery timing may be affected by weather, traffic, or operational conditions.
5.2 We will make reasonable efforts to meet scheduled delivery times but do not guarantee exact arrival windows.
5.3 You are responsible for providing accurate delivery information.
6. Warranties & Disclaimers
6.1 Firewood is provided as a natural product and may vary in size, moisture content, and appearance.
6.2 We use reasonable care to provide properly seasoned firewood but do not guarantee burn characteristics under all conditions.
6.3 We are not responsible for storage conditions after delivery or misuse of firewood.
7. Limitation of Liability
7.1 Our liability is limited to the amount paid for the specific order.
7.2 We are not liable for indirect or consequential damages.
7.3 These limitations apply to the fullest extent permitted by law.
8. Permits & Compliance
8.1 Customers are responsible for complying with local regulations related to firewood storage or use.
8.2 We may decline delivery if conditions are unsafe or non-compliant.
9. Term and Termination
9.1 This Agreement remains in effect until the order is fulfilled.
9.2 We may cancel or refuse service due to unsafe conditions, non-payment, or access issues.
9.3 You remain responsible for payment of completed deliveries.
10. Safety
10.1 We maintain general liability insurance.
10.2 You are responsible for maintaining safe conditions at the delivery location.
10.3 Any damages or hazards must be reported promptly.
11. Force Majeure
We are not liable for delays caused by events beyond our control, including weather, natural disasters, or supply disruptions.
12. Amendments
We may update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.
13. Governing Law & Dispute Resolution
13.1 This Agreement is governed by the laws of the State of Washington.
13.2 Disputes will be resolved through negotiation, then binding arbitration in King County, Washington.
13.3 The prevailing party may recover reasonable legal fees and costs.
14. Severability & Waiver
If any provision is found invalid, the remaining provisions remain enforceable.
15. Entire Agreement
This Agreement, along with your order or invoice, constitutes the full agreement between you and the Company.
